KioBox Terms and Conditions

Article 1 – Origin
The managers of the Thai Café restaurant chain felt uncomfortable not finding eco-friendly packaging on the market that was suitable for their activity. There are all kinds of containers, but they are single-use, intended for a short lifespan, and in one way or another contributing to environmental pollution.
Since, “to change the world, you must first change yourself,” this observation, combined with the lack of available solutions, led to the creation of a complete range of reusable containers under the brand “KioBox.”
Article 2 – Purpose
The main purpose of the KioBox project is to help put an end to the use of single-use packaging, plastic or otherwise, in the Horeca sector, for meals delivered or taken away.
Article 3 – Design
Defining this objective led to the design of packaging that meets several, sometimes conflicting, criteria. To be practical, KioBox containers had to be lightweight, strong, modular, stackable, leak-proof, easy to wash, and aesthetically pleasing.
Article 4 – Concept
KioBox takes up the traditional deposit method to offer a simple way of sharing packaging, namely:
- You buy a product packaged in a KioBox, you pay a deposit.
- You return your KioBox, we refund the deposit.
Rules for Using KioBox
Article 1 – Definitions
- KioBox: “a reusable container and lid, made from recycled materials and branded KioBox, used in takeaway and delivery orders.”
- KioPartner: “a Horeca operator using KioBox containers in takeaway and delivery orders.”
- Deposit: a contractual mechanism by which an amount is temporarily charged or blocked from a user as a guarantee for the return of an item provided. This sum is refunded when the item is returned in good condition, in accordance with the stipulated conditions.
Article 2 – Scope
These terms and conditions govern the relationship between a KioPartner and its customers within the framework of takeaway and delivery services.
By placing a takeaway or delivery order via a KioPartner, the customer indicates that they accept these terms without reservation.
Derogations from these terms are only possible if made in advance, in writing, and specifying the particular article concerned by the derogation. The other provisions remain fully in force.
Article 2 – Principle
A deposit of €1, €2, €3, or €5 per KioBox supplied is added to the total amount of the takeaway or delivery order. When the customer returns the KioBoxes, according to the rules established in these terms, the deposit will be refunded by the KioPartner upon presentation of the purchase receipt for the order.
Article 3 – Payment method
The deposit will be collected using the same payment method employed to pay for the takeaway or delivery order.
KioPartners accept cash, debit/credit cards, and certain mobile payment options.
The deposit will be refunded through our application to a bank account.
Article 3 – Cleanliness
KioBoxes provided to the customer are always clean and in good condition. The KioBoxes must also be returned complete, clean, and in good condition, including lids.
The KioPartner reserves the right not to take back KioBoxes that are not clean or not complete.
Article 4 – Return period
Within two months of the date of the order, the customer may return the KioBoxes to a Thai Café restaurant and recover their deposit, provided they present proof of payment for the order and the number of KioBoxes actually supplied.
Beyond this two-month period, and/or in the absence of proof of payment, the KioPartner reserves the right to refuse to take back the KioBoxes. In any case, no refund will be made if the return takes place more than one year after purchase.
KioBoxes may be returned to any KioPartner, regardless of where the order was placed.
Article 5 – Quantities
KioBoxes are delivered with each takeaway order in the quantities necessary for the orders in question. The user undertakes to return the KioBoxes in the quantities corresponding to the orders received.
KioPartners are not obliged to take back quantities of KioBoxes that clearly exceed those delivered with recent orders.
In the case of large quantities being returned, the user is obliged to prove the date of receipt of their KioBoxes with purchase receipts.
Article 6 – KioBoxes in WPC
First-generation KioBoxes made of grey WPC material can only be returned within the Thai Café network.
Article 7 – Grounds for refusal
Damaged or deformed KioBoxes (notably following passage through an oven) or those that have visibly contained non-food products will not be taken back.
KioBox lids showing abnormal discoloration, notably after being washed with other highly colored foods, will not be taken back. If the lid cannot be taken back, the container will also not be refunded.
Article 11 – Complaints
All complaints regarding takeaway or delivery orders must be submitted the day after receipt, otherwise all rights arising therefrom will be forfeited. Complaints must be addressed to the KioPartner that delivered the product, specifying the nature of the complaint and preferably attaching a photo of the products concerned.
The KioPartner undertakes to respond within five working days to complaints that meet the above conditions.
The KioPartner reserves the right to replace the product in question, grant a voucher in one of its restaurants, or refund the invoiced value.
Article 13 – Intellectual property rights
The “KioBox” brand and logo are protected by intellectual property rights held either by the brand owner or by other rightsholders.
It is prohibited to use and/or modify the intellectual property rights described in this article.
The customer is not authorized to copy or reproduce designs, photos, names, menus, logos, color combinations, or any other media without our prior express written permission. Any unauthorized use is prohibited.
Article 15 – Force majeure
Force majeure means an event beyond the control of a KioPartner, which cannot be attributed to them under law, legal act, or generally accepted views.
The KioPartner cannot be held liable for delay or cancellation of service due to events beyond their control, such as natural disasters, strikes, floods, special weather conditions, epidemics, or technical issues affecting services.
In the event of force majeure, the KioPartner reserves the right to suspend the execution of any order or to dissolve it without judicial intervention, by informing the customer in writing or by phone, without being liable for any compensation.
Article 17 – Amendment of the Terms and Conditions
The KioPartner reserves the right to amend these Terms and Conditions at any time. Amendments take effect as soon as they are published on the KioPartner’s website. The last update was made on 20 February 2025.
Article 18 – Jurisdiction and applicable law
All disputes relating to our offers and/or contracts or arising therefrom are governed by Belgian law. In the event of dispute or litigation, only the courts of the district of our registered office shall have jurisdiction.
